By accessing or using DevOpsTool ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and TST Technology ("we," "us," or "our").

We may update these Terms from time to time. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

DevOpsTool is a server management platform that provides:

• Instance and SSH console management

• Automated backup and restore capabilities

• File management operations

• Deployment automation and monitoring

• API access for integrations

The Service is provided "as is" and we reserve the right to modify or discontinue features at any time.

Upon payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use DevOpsTool in accordance with these Terms.

Each license key is valid for the specific term (monthly or yearly) and server count purchased.

License keys are non-transferable and may not be shared, resold, or distributed without our written consent.

You are responsible for maintaining the confidentiality and security of your license keys.

We offer a free 14-day trial to new users, limited to one trial per user/organization.

Trial licenses include access to all features but may have usage limitations.

Trial licenses automatically expire after 14 days and cannot be extended.

No refunds or credits are provided for unused trial periods.

We reserve the right to terminate trial access at any time for violation of these Terms.

Subscription fees are billed in advance on a monthly or yearly basis as selected.

All fees are non-refundable unless otherwise specified in writing.

Subscriptions automatically renew unless cancelled before the renewal date.

Price changes will be communicated at least 30 days in advance.

Failure to pay fees may result in service suspension or termination.

You agree not to:

• Use the Service for any illegal or unauthorized purpose

• Reverse engineer, decompile, or attempt to extract source code

• Share license keys or allow unauthorized access

• Use the Service to manage servers you do not own or have permission to access

• Attempt to bypass security measures or access restrictions

• Interfere with the proper functioning of the Service

You retain ownership of all data you input into or generate through the Service.

We implement reasonable security measures, but cannot guarantee absolute security.

You are responsible for maintaining secure access to your servers and systems.

We are not liable for data loss, security breaches, or unauthorized access to your systems.

Regular backups of your data are your responsibility.

We strive to maintain high service availability but do not guarantee uninterrupted access.

Scheduled maintenance will be announced in advance when possible.

We are not liable for service interruptions, downtime, or resulting business losses.

Service Level Agreements (SLAs) may be available for enterprise customers.

You may terminate your account at any time by cancelling your subscription.

We may terminate or suspend your access for violation of these Terms.

Upon termination, your access to the Service will cease, but data retention policies may apply.

No refunds will be provided for early termination unless required by law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND

• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES

• OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM

• WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

These Terms are governed by the laws of the jurisdiction where TST Technology is incorporated.

Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in effect.
